Welcome to PACIFIC. By purchasing, booking, or using any service provided by Pacific Creative Studio or any of its divisions, you agree to the following Terms & Conditions.
These terms apply to all services unless otherwise stated in the specific division section below.
About Pacific
PACIFIC is a creative studio operating through the following divisions:
Each division may have additional service-specific policies which supplement these general Terms & Conditions.
General Terms
Quotes & Pricing
All quotations remain valid for 30 days unless otherwise stated. Prices are subject to change without notice until a quote has been accepted. Applicable taxes (VAT) are added where required.
Payments
Unless otherwise agreed:
- A deposit/payment is required before work begins.
- Remaining balances are due according to your proposal or agreement.
- Late payments may delay work or delivery.
- Outstanding invoices may result in suspension of services.
Accepted payment methods include:
- Credit Card
- Local Costa Rican Bank Transfer
- Cash (USD/CRC)
- PayPal
Payment processors may appear as:
- Pacific
- Pacific Photography
- Pacific Marketing
Intellectual Property
Unless otherwise agreed in writing: PACIFIC retains copyright to all creative work produced. Clients receive the agreed usage rights upon full payment. Raw files, source files, design files, and editable project files remain the property of PACIFIC unless specifically included in the agreement.
Portfolio Usage
PACIFIC reserves the right to display completed work within:
- Portfolio
- Website
- Social Media
- Marketing Materials
- Awards
- Publications
unless confidentiality has been agreed in writing.
Delays
PACIFIC is not responsible for delays caused by:
- weather
- acts of nature
- government restrictions
- client delays
- third-party suppliers
- internet outages
- hosting providers
- platform outages
Project timelines may be adjusted accordingly.
Company
- Services are completely bilingual (English & Spanish).
- Costa Rica-based, but travels outside the country for work once quoted and payment is completed.
- We are equipped with all the professional equipment needed to provide you with the services stated on our websites.
- We don’t sell your information; all the information we gather is provided by you and solely for contact purposes and to send you the finished product.
Limitation of Liability
PACIFIC shall not be liable for indirect, incidental, or consequential damages resulting from the use of our services. Maximum liability shall never exceed the amount paid by the client.
Governing Law
These Terms shall be governed by the laws of Costa Rica.
Pacific Photography
Booking
A booking is confirmed only after:
- Deposit Received
Dates are never held without payment.
Payments
- Tax (VAT 13%) is not included.
- Tips are not included in the pricing, but are always welcome.
- Additional time rate is $100/hour.
- Rates for Central Valley (San Jose) – Central Pacific (Jaco).
- External rates are available and will be supplied by an agent (an additional fee may include transportation, lodging, and other expenses).
- All Services require a minimum a NON-REFUNDABLE* (review cancellations section) 50% deposit to HOLD the dates/reservation.
- Payment of the balance is due on the day of the session.
- Prices do not include prints, and we will send all files digitally.
- Waiting to reserve can result in no available dates (we always recommend reserving within an anticipated timeframe).
- PayPal, Credit Card (via invoice link), Local Bank Transfer, & Cash (USD/CRC).
- Payment processors may state Pacific, Pacific Marketing Agency & Pacific Photography.
Turnaround
- Turnaround for photography sessions is typically within the one to two-week range.
- Turnaround for video production is typically within the two to four-week range.
- Turnaround for weddings is typically within the four to five-week range.
- A private online gallery is included for our customers (valid for 6 months), after which we do not save your work. We are not responsible if you do not download it within the specified timeframe.
- The stated number of photographs is a minimum base; depending on the group size, we will always strive to provide you with the most & best pictures from the photographer’s selection.
Cancellations
We offer a 48-hour grace period after your initial deposit is made. If you contact us within this timeframe, you are eligible for a full refund of your deposit. After 48 hours, deposits become non-refundable, as your date and time are reserved and removed from our availability. However, we understand that plans can change, and in many cases, rescheduling may be possible depending on availability.
When rescheduling applies, clients are permitted one (1) complimentary reschedule of their reserved session or event date, subject to availability. If the rescheduled date is later cancelled, postponed again, or not attended for any reason, the original deposit/payment made will be forfeited. To secure any future date after a rescheduled booking has been cancelled, a new full payment and signed agreement will be required.
Please note that all rescheduling requests must be submitted directly to and confirmed by Pacific Photography. New dates are not guaranteed until officially approved by our team. Pacific Photography reserves the right to decline additional rescheduling requests beyond the one (1) permitted reschedule.
Please note that payment processing fees on deposits are non-refundable, as they are charged by third-party providers.
RAW Content
At Pacific Photography, we take great pride in delivering polished, professionally edited imagery and video that represents our creative vision and quality standards. For this reason, RAW photo and video files are not included or distributed, as they are unfinished production assets. All final deliverables are carefully selected and edited by our team to ensure the highest professional presentation.
We retain RAW content for a maximum of 30 days from the session for any necessary modifications. After this period, all RAW content will be deleted.
Copyright
All photographs and media captured by Pacific Photography remain the intellectual property and copyrighted works of the photographer. Upon full payment, the client is granted a non-exclusive license to use the delivered images for personal and/or approved business marketing purposes. This license does not transfer copyright ownership. Images may not be resold, altered for commercial redistribution, submitted to contests, or provided to third parties for resale or commercial use without prior written consent from the photographer.
The client also acknowledges and agrees that Pacific Photography may use selected photographs, videos, and media captured during the service for promotional and marketing purposes, including but not limited to social media, website portfolios, advertising materials, publications, and other business-related outlets, unless otherwise agreed upon in writing prior to the service date.
Pacific Weddings
Booking & Payments

- Waiting to reserve can result in no available dates (we always recommend reserving within an anticipated timeframe).

- Payment processors may state Pacific, Pacific Marketing Agency & Pacific Photography.
Planning Services
Planning timelines vary depending upon the wedding package selected.
Vendor Coordination
PACIFIC coordinates vendors but cannot be held liable for services provided by third-party vendors.
Guest Count
Final guest numbers must be confirmed before deadlines established within your planning agreement.
Venue Changes
Venue changes after planning has begun may require additional planning fees.
Weather
Outdoor weddings remain subject to weather.
Backup plans are strongly recommended.
Payment
Payment schedules are outlined within each wedding agreement.
Late payments may delay planning services.
Wedding Day Schedule
Clients are responsible for providing the final timeline.
Schedule changes made during the wedding day may impact photography, videography, and planned coverage.
Copyright

Pacific Marketing
Starting Your Project
Projects are confirmed only after:
- Payment Received
Work doesn’t begin without payment.
Scope of Work
Services are limited to the scope outlined within the approved proposal. Additional work will require a revised quotation.
Social Media
Clients remain responsible for:
- account ownership
- login credentials
- platform policies
PACIFIC cannot guarantee follower growth or viral performance.
Content Approval
Marketing materials requiring client approval may delay campaigns until approved.
Advertising
Google Ads, Meta Ads, and other advertising platforms require separate advertising budgets paid directly to the platform unless otherwise agreed. Budgets are subject to 13% VAT which will be charged by the operator. Advertising performance cannot be guaranteed.
SEO
Search Engine Optimization is an ongoing strategy. PACIFIC does not guarantee:
- rankings
- traffic
- conversions
Search engine algorithms are controlled by third parties.
Monthly Services/Subscriptions
Monthly retainers renew automatically according to the agreement unless cancelled in accordance with contract terms.

Project Timeline
Projects are confirmed only after:

Work doesn’t begin without payment.
Project Timeline
Typical website projects are completed within approximately 14-90 days, depending upon:
- client response time
- supplied content
- revisions
- project scope
Content
Clients are responsible for providing:
- logos
- branding
- text
- images
- legal pages
unless content creation has been included.
Revisions
Every project is shown to the client before going live to the public, at this moment we require revisions from you to ensure the project continues as forecasted.
Website Subscriptions
Subscription clients become eligible for a website buyout after completing six (6) months of active service. The buyout option allows you to transition from a monthly subscription to full ownership of your website.
The buyout fee is $650+tax and includes:
- Full ownership of your website
- Transfer of all website credentials and administrative access
- One (1) year of website hosting included
- One (1) year of domain registration included
- One (1) year of SSL security included
Once the buyout is completed, you will have full control of your website and may continue hosting with us or choose to manage the website independently or through another provider.
Website Ownership
Ownership transfers only after:
- full payment
- completion of the agreed project
Subscription websites remain the property of PACIFIC until purchased under the Buyout Program.
Website Hosting
If hosted by PACIFIC, Hosting includes:
- access to cpanel
- ftp account
PACIFIC is not responsible for outages caused by third-party hosting providers.
Domains
Clients own their domain name when registered in their name. Subscriptions remain the property of PACIFIC until purchased under the Buyout Program.
PACIFIC may manage domains on behalf of clients.
Third-Party Software
Websites often rely on:
- WordPress
- Plugins
- Payment gateways
- APIs
- Hosting providers
PACIFIC is not responsible for changes, discontinuation, or failures of third-party software.
Website Warranty
Following project completion:
- Development defects reported during the included support period will be corrected at no additional charge.
- New features or functionality requested after approval are considered new work and quoted separately.
